2. Service description

We provide AI-powered image upscaling. You buy digital credits (one-time, no subscription). Credits can be used to upscale images via our product. We may improve or change features, but core functionality is to deliver higher resolution outputs from your inputs.

3. Accounts

You must keep credentials secure and ensure information is accurate. You are responsible for activity on your account. If you suspect unauthorised use, notify us promptly.

4. Acceptable use

• No unlawful, harmful, hateful, harassing, or infringing content.
• No content involving minors, non-consensual activity, or other abusive material.
• No attempts to disrupt, reverse engineer, or misuse the Service.
• No automated scraping or rate abuse; respect any rate limits communicated.

5. Intellectual property

You retain rights to your uploaded content. You grant us a limited license to process it solely to provide the Service. We own the platform, code, models, and branding.

6. Pricing, taxes, and currency

Prices are shown in euros (EUR) unless stated. Taxes are added where applicable. You authorise us and our payment partner to charge your chosen payment method for the displayed amount.

7. Delivery of credits

Credits are delivered instantly to your account once payment succeeds. Credits may be used any time while the Service is available. If we ever sunset the Service, we will provide reasonable notice where possible.

8. Refunds & right of withdrawal (digital goods)

Because credits are delivered instantly, EU law requires your consent to immediate delivery and acknowledgement that the statutory right of withdrawal is lost once delivery begins. If you do not use any credits, you may request a refund within 14 days of purchase. Once any credit is used, the purchase is non-refundable.

To request a refund (unused credits only), email support@ndey-kntent.com from your account email. Approved refunds go to the original payment method.

9. Chargebacks & disputes

If you open a chargeback, we may suspend the account while we investigate. We contest illegitimate disputes and may recover associated fees.

10. Service availability & termination

We aim for high availability but do not guarantee uninterrupted access. We may suspend or terminate accounts that violate these Terms or applicable law. You may stop using the Service at any time.

11. Warranties & liability

The Service is provided “as is” without warranties. To the maximum extent permitted by law, our liability is limited to the amounts you paid in the 6 months preceding the claim. Nothing excludes liability where unlawful to do so.

12. Governing law & venue

These Terms are governed by Austrian law. Courts in Vienna, Austria have exclusive jurisdiction, subject to any mandatory consumer protections under your local law if you act as a consumer in the EU/EEA.

13. Changes to these Terms

We may update these Terms to reflect changes to the Service, legal requirements, or business needs. Material changes will be notified via the site or email. Continued use after changes constitutes acceptance.
